§ 1 Scope

(1) These General Terms and Conditions ("Terms") govern all contracts concluded between Taibon Karin KG & Co ("Hotel") and the guest ("Guest") concerning accommodation at Hotel Monte Paraccia and Pension Pè de Munt and any related services including restaurant, wellness, and event services.

(2) Deviating terms of the Guest shall only become part of the contract if the Hotel expressly agrees to them in writing.

(3) The Guest acknowledges the validity of these Terms upon submission of a booking enquiry.

(4) For bookings made via the HGV booking widget integrated on our website, the terms of the widget operator displayed during the booking process shall additionally apply, which the Guest accepts as part of the booking process. In case of doubt, the terms set out here shall prevail.

 

§ 2 Conclusion of Contract

(1) The accommodation contract is concluded upon the Hotel's acceptance of the Guest's booking enquiry. The booking may be submitted in writing, by email, telephone, via the booking widget on our website, or via online booking platforms.

(2) The Hotel's written booking confirmation constitutes acceptance of the enquiry. Upon receipt of the confirmation by the Guest, the contract is legally binding.

(3) The contracting parties are the Hotel and the Guest. If the Guest books for a third party, the Guest shall be jointly and severally liable with the third party for all obligations under the contract.

 

§ 3 Prices and Payment Terms

(1) The prices agreed at the time of booking shall apply. Prices are quoted in Euro and include applicable VAT unless otherwise stated.

(2) Tourist tax (Imposta di soggiorno): In addition to the agreed accommodation price, a tourist tax is charged pursuant to South Tyrol Provincial Law No. 9/2012, calculated per person aged 14 years and over and per overnight stay. The tax is payable in cash upon arrival:

  • Hotel Monte Paraccia: EUR 3.20 per person/day
  • Pension Pè de Munt: EUR 2.70 per person/day

The tourist tax is exempt from VAT pursuant to Article 15 DPR 633/72.

(3) The final price includes, where booked, half-board (see § 7) and any additional services specified in the booking confirmation.

(4) An increase in statutory taxes, levies, or tourist tax rates following conclusion of the contract entitles the Hotel to adjust the agreed prices accordingly.

(5) Invoices are due for payment without deduction within 8 days of receipt, unless otherwise expressly agreed. In the event of late payment, the Hotel is entitled to charge default interest at the statutory rate.

(6) Accepted payment methods are: bank transfer, cash (within statutory limits), major credit and debit cards, and PayPal.

 

§ 4 Deposit

(1) Upon conclusion of the contract, the Hotel is entitled to request a deposit of 30 % of the total price.

(2) The deposit shall be transferred to the account indicated by the Hotel within 7 days of invoicing. If the deposit is not received in due time, the Hotel may withdraw from the contract and allocate the room otherwise.

(3) The deposit shall be credited against the final invoice. In the event of free cancellation pursuant to § 5, the deposit shall be refunded in full; in the event of cancellation subject to a fee, it shall be offset against the cancellation fee.

 

§ 5 Cancellation by the Guest

(1) Any cancellation must be submitted in writing (by email or letter). The receipt of the cancellation notice by the Hotel shall be decisive for the calculation of cancellation fees.

(2) The following cancellation fees apply as a percentage of the total stay price (HGV standard conditions):

  • up to 90 days before arrival: free of charge (the deposit paid will be refunded)
  • 89 to 30 days before arrival: 25 %
  • 29 to 15 days before arrival: 50 %
  • 14 to 2 days before arrival: 80 %
  • from 1 day before arrival and in case of no-show: 100 %

(3) In the event of early departure, the Hotel is entitled to charge the full agreed price unless the room can be re-let.

(4) The Guest reserves the right to prove that the Hotel has incurred no damage or a substantially lower amount of damage.

(5) We recommend the conclusion of an appropriate travel/trip cancellation insurance.

 

§ 6 Arrival and Departure / Check-in and Check-out

(1) Booked rooms are available to the Guest from 3:00 p.m. on the agreed day of arrival. Earlier check-in is subject to availability and prior arrangement.

(2) On the day of departure, rooms must be vacated by 10:30 a.m. at the latest. Late check-out may be granted subject to availability and at an additional charge.

(3) For arrivals after 7:00 p.m., the Hotel requests advance notice. In the case of unannounced late arrivals, the Hotel reserves the right to allocate the room otherwise from 7:00 p.m. onwards.

(4) Pursuant to Italian law (Article 109 TULPS), the Guest is required to present a valid photo ID (identity card, passport) upon check-in for registration purposes. This data is transmitted to the Questura in accordance with statutory requirements.

 

§ 7 Catering and Inclusive Services

(1) The booked stay includes the catering and ancillary services specified in the booking confirmation (e.g. bed & breakfast, half-board). A detailed description of the services included is available on our website at paraccia.com/inclusive-services.

(2) Meals not consumed by the Guest will not be refunded.

(3) Special requests and dietary requirements (intolerances, allergies, vegetarian or vegan meals) should be communicated to the Hotel in good time before arrival.

 

§ 8 Wellness and Activity Programme

(1) The Hotel features a wellness area with Finnish sauna, Turkish steam bath, organic sauna, infrared sauna, Kneipp bath, and relaxation room. Use is included in the room rate unless otherwise agreed. The house rules of the wellness area are binding.

(2) The use of the sauna is reserved for adults; children may enter the wellness area only when accompanied by a parent or guardian and in accordance with the house rules.

(3) External services (ski passes, ski rental, paid ski depot, massages, ski school, guided tours, etc.) are not included in the room rate and are invoiced separately.

 

§ 9 Pets

(1) At Hotel Monte Paraccia, pets are not permitted in the rooms. However, they may be brought into the common areas of the Hotel (e.g. bar and lobby).

(2) At Pension Pè de Munt, pets are permitted both in the rooms and in the common areas subject to prior arrangement, availability, and an additional charge. Please inform us of the type and size of the animal at the time of booking.

(3) Pets are generally not permitted in restaurant, breakfast, and wellness areas.

(4) The Guest is liable for any damage caused by the pet.

 

§ 10 House Rules

(1) The Guest undertakes to comply with the Hotel's house rules and the rules governing the use of the wellness area. The Guest shall follow the instructions of the Hotel staff.

(2) Quiet hours apply from 10:00 p.m. to 7:00 a.m.

(3) The Hotel is a non-smoking establishment. Smoking is permitted exclusively in the designated outdoor areas. In the event of a violation of the no-smoking rule in rooms or common areas, a cleaning charge of EUR 200.00 will be levied.

(4) In the event of serious or repeated violations of the house rules, the Hotel is entitled to terminate the contract without notice, without granting the Guest any claim for refund of the accommodation price.

 

§ 11 Liability of the Hotel

(1) The Hotel's liability for its principal contractual obligations is governed by statutory provisions.

(2) Liability for items brought into the Hotel by the Guest is governed by Articles 1783 et seq. of the Italian Civil Code. Valuables, cash, jewellery, and securities must be deposited in the Hotel safe; otherwise, liability is limited to the statutory maximum amount.

(3) Where a parking space, even paid, is made available to the Guest on the Hotel premises, no safekeeping agreement is concluded. There is no obligation to monitor. The Hotel accepts no liability for loss or damage to vehicles parked or manoeuvred on the Hotel premises or their contents, except in cases of wilful intent or gross negligence.

(4) The Hotel accepts no liability for external services provided by third parties (e.g. ski school, ski rental, tour operators), even where booked through the Hotel.

 

§ 12 Force Majeure

In the event of force majeure (in particular natural disasters, pandemics, governmental measures, war), the fulfilment of contractual obligations is suspended for the duration of the impediment. Deposits already paid will, in such cases, be refunded — proportionately or in full — as credit or as a refund, to the extent required by law.

 

§ 13 Stays with Children

(1) Children are most welcome at the Hotel. Upon request and subject to availability, we provide the following equipment free of charge: cot, bottle warmer, baby monitor (on reservation), child seat, backpack, and stroller.

(2) Parents or guardians remain responsible for supervising children throughout their stay. This applies in particular to the use of the wellness area, play areas, and outdoor facilities.

 

§ 14 Data Protection

The processing of Guests' personal data is carried out in accordance with the General Data Protection Regulation (GDPR) and applicable Italian law. Details are set out in our Privacy Policy.

 

§ 15 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), available at https://ec.europa.eu/consumers/odr. The Hotel is not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

 

§ 16 Final Provisions

(1) The contract is exclusively governed by Italian law, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) The exclusive place of jurisdiction for all disputes arising from this contract is Bolzano (BZ), Italy, where the Guest is a business or has no general place of jurisdiction within Italy. For consumers, mandatory statutory places of jurisdiction remain unaffected.

(3) If individual provisions of these Terms are or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by such valid provision that comes closest to its economic purpose.

(4) The German version of these Terms shall prevail. Translations are provided for information purposes only.
